These conditions define the procedure for ordering, payment, delivery and return of goods offered on the website The seller of the goods offered on this page is Gems-Vibes, Tihomir Matijevic s.p., Tržaška cesta 204, 1000 Ljubljana, Slovenia
, and the Buyer of the goods is a visitor of the online store who selects at least one product, fills in the electronic order form and sends it to the Seller.


The customer can register on the page Upon registration, the customer is required to enter their own email address and password. The customer does not have to be registered to buy items through the online store.

Ordering goods

Goods are ordered exclusively by electronic order form; basket. The customer is asked to enter contact information and provide his own and delivery address in order to complete the ordering process. If the Seller is not able to deliver certain items, he will notify the buyer by e-mail about the same within a maximum of 3 working days. Ordering goods is possible 24 hours a day, 7 days a week, except in situations where the opposite is pointed out on the page. All orders received on Friday after 4pm or on a holiday will be processed on the first following business day.

Upon completion of the order, the Buyer will be notified by e-mail of receipt of the order. If payment by bank transfer is selected, the buyer according to the payment information specified in the confirmation e-mail should make the payment within 3 working days to the Seller’s account.

Termination of the Purchase Agreement

The User may request a refund and unilaterally terminate the Contract within 14 (fourteen) days of delivery of the goods to the buyer without giving a reason.

The User has no right to unilaterally terminate the Agreement:

if the service has been fully performed and the performance has started with his explicit prior consent and with his confirmation that he is aware of the fact that he will lose the right to unilateral termination of the Contract if the service is fully performed
if the subject of the Contract is goods which, due to their nature, are inseparably mixed with other things after delivery,
if the subject of the Agreement is the delivery of sealed audio or video recordings, or computer programs, which are unsealed after delivery and no further use is possible
In order for the user to be able to exercise the right to unilaterally terminate the Agreement, he must inform Gems-Vibes, Tihomir Matijević s.p. on its decision to unilaterally terminate the Agreement before the deadline.

Return of goods

In the event that the purchased item does not respond, it is possible to replace it or request a refund. The request for return of goods must be sent together with the goods to the address:

A copy of the ID card and account card (with a visible IBAN number) must be sent with the completed refund form. The Buyer returns the goods to the Seller at his own expense. If the returned goods are undamaged, ie the original labels have not been removed and are in the original packaging, it is possible to replace the product (according to the conditions of its execution) or return the funds to the customer’s account. The request for return of goods must be sent together with the goods within 14 days of receipt of the shipment.

Replacement of goods

Replacement of goods is possible for all items within 14 working days of receipt of the shipment. The request for replacement of goods must be sent together with the goods to the address:

The customer chooses whether he wants to change the product for the same product of a different size or color, or for a completely new product. The request for replacement of goods must be sent together with the goods within 14 days of receipt of the shipment. The Buyer shall bear the cost of sending the goods to the Seller.

If the returned goods are undamaged (the original labels have not been removed, they are in the original packaging), a product of another size or color or a completely new product is sent to the Buyer. If the value of the replacement item is less than HRK 500, the Buyer will be charged a postage fee of HRK 45 for sending the replacement item. If the value of the replacement item is higher than HRK 500, the Seller shall bear the cost of sending the replacement item.

If the goods are not in proper condition, the buyer must pay the amount of postage of 45 kn in order for the goods to be sent back to the home / delivery address. If the new product is of higher value than the first purchased product, the Buyer is obliged to pay the difference the next time the goods are picked up. If the value of the new product is less than the first purchased, the Seller is obliged to refund the difference to the Buyer within 30 days by payment to the Buyer’s account (the Buyer is obliged to send a copy of the invoice card with visible IBAN number).


The buyer has the right to complain. Complaints are sent in writing or to the e-mail address with the title; COMPLAINT, no. orders. The Buyer is obliged to return the product to the Seller within the agreed period to the agreed address. A complaint is considered valid if it meets the conditions for a complaint in accordance with the Civil Obligations Act and the Consumer Protection Act. The Seller is obliged to replace the product or return the entire amount paid to the Buyer within 20 days of receiving a valid complaint. Pursuant to the provisions of Article 404, paragraph 2 of the Civil Obligations Act, more than 6 months have passed since the purchase and delivery of the product and as a seller we are not responsible for any hidden defects that may have been on that product.

Gems-Vibes undertakes to protect the personal data of customers and takes all necessary technical and organizational measures in accordance with best practice and obligations prescribed by Croatian law and the General Data Protection Regulation (EC 2016/679) – GDPR by collecting only the necessary, basic information about customers / users that are necessary to fulfill our obligations; informs customers about how to use the collected data, regularly gives customers a choice about the use of their data, including the ability to decide whether or not to have their name removed from the lists used for marketing campaigns. All user data is strictly kept and is available only to employees who need this data to do their job. All Gems-Vibes employees and business partners are responsible for adhering to the principles of privacy protection.

Terms of delivery

The goods are delivered by the courier service of the Post of Slovenia, the Post of Croatia, for the entire territory of Croatia. Services are automatically charged in the cart.

Information on the web store

Gems-Vibes makes every effort to keep the information on the web store website up-to-date and accurate. Gems-Vibes cannot guarantee the 100% accuracy of all displayed product and service information. In exceptional cases, discrepancies between the actual data and the data available on the website are possible. Gems-Vibes undertakes in any such case to revise the order and agree on alternatives with the customer. Likewise, product photos do not always have to match products that are actually available and should only be understood as an informative illustration.

Return or exchange of goods is possible in the event that you have not removed the original labels from the ordered items, and when you have the original boxes in which the items were delivered. Ordered items can be exchanged for the same items of another size or another item (or items).

In case of a complaint, the buyer is obliged to return the product to us within the agreed time. We will consider the complaint valid if the inspection of the product determines that it meets the conditions for a complaint in accordance with the Civil Obligations Act and the Consumer Protection Act. In this case, we will replace the product or refund the full amount paid within 15 days of receiving a valid complaint.
